Employee Rights

Overview:

The employment relationship in Florida places much of the power and authority with the employer, but there are a few state and federal laws designed to protect employees from discrimination, harassment, overtime violations, and other forms of illegal employer conduct.

Free Consultation:

If you feel that you have faced illegal employer conduct, then please join me for a free consultation. No matter the client, we will provide a free consultation within 24 hours to clients in need of assistance. Consultations usually happen in person at one of our office locations, but they can also occur via video conference or simply over the phone. We work to find a means of communication that fits our clients’ needs.

Client Focused:

In all cases, we work with our clients to achieve the best possible results. We represent our client’s interests aggressively and effectively while always maintaining the highest ethical and professional standards. It is our number one goal to resolve our clients’ legal issues with the highest possible recovery for the client.

Trial Preparation:

We strive to provide our clients with personal attention and a hands-on approach throughout the litigation process. Painting a realistic and honest assessment of the potential results of litigation facilitate a transparent and coordinated representation. We believe in educating our clients about their case so they have the knowledge necessary to make truly informed decisions. We always provide personalized and attentive service to every case because we believe it is essential to achieve the best possible outcome.

Contingency Fee (No out of pocket cost):

In a contingent fee arrangement, the lawyer agrees to accept a fixed percentage (often one third) of the recovery, which is the amount finally paid to the client. If you win the case, the lawyer’s fee comes out of the money awarded to you. If you lose, neither you nor the lawyer will get any money, but you will not be required to pay your attorney for the work done on the case.

Client Reviews

We were very fortunate to find Mr. Malatesta to handle a potential job loss after 22 years in a public servant role. He had a great strategy and handled the matter efficiently. We are very grateful for a positive outcome. We highly recommend him!

Frank is an excellent attorney, with a very family like approach. He makes you feel completely comfortable, which enables you to tell your truth. I hope I never need a attorney again..but if I do I’m most certainly calling on Malatesta Law Office. (His paralegal Melody is an absolute sweetie pie.)

Frank went up against a juggernaut of a large financial company ( complete with a large team of lawyers on staff ) - Frank won my case ! Not only did he get my job back, he was able to negotiate backpay for me too. Mr. Malatesta is as genuine as they come , very fair with pricing - the level of care...

Mr Malatesta made a difficult process very bearable. His confidence and knowledge of the labor law field gained my confidence since the beginning of his representation. I would recommend attorney Malatesta to anyone that is looking to be represented by the best!

Frank did a great job on my case. Frank has always been there to answer my questions and put my mind at ease with legal questions that I have. Frank makes me feel like an individual and not a case file number. I definitely recommend him to everyone.
